Early morning “sh#t talking” and gun-slinging leads to aggravated assault charges

38-year-old Toimel Hemphill was charged with four counts of aggravated assault, felon in possession handgun, and missing ID plate after waving a gun and making threats random at people and children.

On September 27th, Deputy Trent and Moncier were dispatched to an aggravated assault at 449 Elmfield Cove. Upon arrival, deputies made contact with Toimel Hemphill. After contact was then made with Leah Taylor who stated that Toimel was outside and started “talking shit” to him for no reason. Derrell Kirk stated that he was sweeping the front porch when Toimel started yelling at him wanting to fight. Derrell tried to ignore him in hopes that he would go back inside and be left alone. At that time, Toimel went inside the house then came back out with a handgun and start waving it around and making threats. This is when Leah called the police.

Both witnesses, Sandra Wilbourn and Keosha Burks, confirmed these acts. Keosha showed deputies video footage on her cell of Toimel waving the gun at people and children. Toimel then went inside his house to put the gun up. He then came back outside and sat on an electrical box. According to the affidavit, it was later found that he was diagnosed with paranoid schizophrenia.

This information was stated by his sister Toymeka Byears who spoke with her brother and he told her there was a gun in the house. Consent was given by Toymeka to search and retrieve the gun, which was found under a seat cushion of the living room sofa. Being a felon, Toimel stated he had a friend purchase the gun for him at Guns & Ammo on Summer Avenue and that he altered the serial number.

Toimel Hemphill was arrested and charged with four counts of aggravated assault, possession of an item with missing ID plate, and felony possession of a handgun. His bond was set at $20,000.
