29-year-old Decorius Smith was charged with aggravated statutory rape after he was caught in his vehicle on James Road with a 16-year-old female with his pants halfway down, per report.
On May 7th, MPD officers came into contact with a suspicious 2009 burgundy BMX X3 in the 2200 block of James Road. Upon approaching the vehicle, officers spotted a female in the back seat putting her pants back on and a male with his pants halfway down.
Officers discovered the female was only 16 years old and identified the male as 29-year-old Decorius Smith. The female reported to officers Decorius had picked her up from the Tall Trees Apartments in his vehicle and drove them to the park and had sex.
The juvenile female went into more detail by stating that Decorius performed penile-oral sex on her, engaged in digital and penile penetration of her vagina and that he used a condom. Decorius was taken into custody and transported to the Sex Crimes Bureau, where he was Mirandized and refused to give a statement or sign the Rights Waiver.
Decorius Smith was arrested and charged with aggravated statutory rape. His bond was set at $1,000.
